This Privacy Policy applies to the seeQL ERD Diagram Editor available at seeql.app.

2. Information We Collect

  • Account Information: To log in you may use either (a) a one-time code sent to your email address or (b) GitHub OAuth authentication. We do not store passwords.
  • Usage Data: Interactions with the diagram editor, AI chat history, and diagrams you create or modify.
  • Payment Information: Payments are handled by Polar (polar.sh). We do not store credit card or billing details.
  • Technical Data: IP address, device and browser information, approximate location, and log data.
  • AI Content: Prompts, messages, and context sent to the OpenAI API to provide AI responses.

3. Legal Basis for Processing (EU/EEA)

  • Performance of a contract – Art. 6(1)(b) GDPR (to provide and operate the Service).
  • Legal obligations – Art. 6(1)(c) GDPR (e.g., tax compliance).
  • Legitimate interests – Art. 6(1)(f) GDPR (security, preventing abuse, improving the Service).
  • Consent – Art. 6(1)(a) GDPR (where required, e.g., for optional marketing).

4. How We Use Your Information

  • Provide, maintain, and improve the Service and its AI features.
  • Enable secure login via email one-time code or GitHub OAuth (no password storage).
  • Process payments and manage subscriptions via Polar.
  • Provide support and communicate updates and security notices.
  • Ensure compliance with legal obligations and protect against abuse.

5. Data Sharing

We do not sell personal data. We share information only with trusted service providers:

  • Convex (convex.dev): backend hosting and data storage.
  • Cloudflare (cloudflare.com): frontend hosting, CDN, and security services.
  • Polar (polar.sh): payment processing and billing.
  • OpenAI (openai.com): AI inference for chat-based features.
  • GitHub (github.com): OAuth login provider (if you choose GitHub login).
  • Email provider: To deliver one-time login codes for authentication.

6. International Data Transfers

Your data may be processed outside the EU/EEA (including the United States). We rely on safeguards such as EU Commission adequacy decisions and/or Standard Contractual Clauses (Art. 46 GDPR).

7. Data Retention

  • Account and diagram data are retained while your account is active.
  • AI conversation history is stored for your convenience and can be deleted upon request.
  • We retain only the minimum login data necessary (e.g., email address or GitHub ID). We do not store passwords.
  • Data is kept only as long as required for the purposes described or by law.

8. Cookies and Tracking

We may use essential cookies and similar technologies (e.g., for authentication and security). Where legally required, we will request your consent for non-essential cookies.

9. Your Rights (EU/EEA)

As a data subject under GDPR, you have the right to:

  • Access your personal data (Art. 15 GDPR).
  • Request rectification (Art. 16) or erasure (Art. 17).
  • Restrict processing (Art. 18) and request data portability (Art. 20).
  • Object to processing (Art. 21).
  • Withdraw consent at any time (Art. 7(3)).
  • Lodge a complaint with a supervisory authority (Art. 77), e.g., in Germany or your local EU state.

10. California / U.S. Privacy Rights

We implement appropriate technical and organizational measures to protect your data. However, no method of transmission or storage is completely secure.

12. Children’s Privacy

The Service is not directed to children under 13 (or under 16 in the EU). We do not knowingly collect personal information from children.

Our Service may contain links to third-party sites. We are not responsible for the privacy practices of those third parties.

We may update this Policy from time to time. We will post the updated version and update the “Effective Date.”
